The General Administration of Customs of the People’s Republic of China (GACC) is the Chinese government’s customs agency.
GACC has implemented facility and product registration requirements under their Decree 248 that affect overseas or non-Chinese food manufacturers, processors, and in some cases, storage facilities of food products exported to China.
The exportation process works as follows:
- Food companies planning to export products to China provide information to FDA
- FDA approves company to ship to China
- FDA provides list of approved exporters to GACC
- GACC publishes public list of approved exporters each quarter
Beginning January 2022, any companies currently shipping to China must submit their registration using the update process.
Your company must submit a separate application for each Food Product Category that you are shipping. In other words, if you are shipping three different kinds of crackers, you can list all three on one application. But, if your shipment to China includes dried fruit as well as crackers, you must submit a separate application for the dried fruit.
Food products that must be listed with a “local, competent authority” include:
- Infant formula milk products
- Meat and meat products
- Dairy
- Bird’s nests and bird’s nest products
- Casings
- Bee products
- Eggs and egg products
- Edible oils and fats
- Stuffed pastry products
- Edible grains, milled grain industry products, and malt
- Dehydrated and fresh vegetables and dried beans
- Condiments
- Natural plant products and seasonings
- Nuts, seeds, and dried fruits
- Unroasted coffee beans and cocoa beans
- Foods for special dietary purposes and health food
No. The products being shipped to China must be legally marketed within the United States or meet the requirements of Section 801(e)(1) of the FD&C Act. However, this only applies to companies operating within the U.S.
At least one of the products in the application must have been shipped to China previously, and you must provide the date of the last consignment of the product.
Yes. The facility must have been inspected by a state or federal agency, and you must provide a copy of the inspection report.
Export Listings for FDA must be updated every other year (biennially) for companies located in the U.S., just like Food Facility Registrations. The China export list must be renewed every 5 years.
