When a foreign supplier is exporting food, beverages, or dietary supplements to the U.S., the FDA requires the U.S. buyer or importer to have an FSVP that assures the food imported meets FDA’s food safety requirements. However, if you are “self-importing,” meaning there is no U.S. owner for the food at the time of entry into the United States, you must designate an FSVP Agent to conduct those activities.

Foreign suppliers (exporters) who are shipping food, beverages, or dietary supplements into the U.S. without a U.S. owner or consignee at time of entry must have a designated FSVP agent. Essentially, if there is no U.S.-located buyer at the time an entry is submitted, the foreign exporter must have an FSVP Agent to comply with FSVP.
At a high level, an FSVP Agent is the person taking responsibility for conducting supplier verification activities on behalf of a foreign owner. The agent must provide assurances that the food offered for import meets the U.S. FDA requirements and is safe. An FSVP Agent will be listed as the FSVP Importer of the food at time of entry, and they will be subject to FDA FSVP inspections on your behalf. Your FSVP Agent must be highly qualified with the knowledge and expertise in food safety and applicable FDA regulations in order to develop and implement an FDA compliant program.
If you are shipping directly to a specific buyer, that buyer is the FSVP Importer and you are not required to nor are allowed to designate an FSVP Agent. We encourage suppliers to ask their buyers if they are compliant with FSVP to ensure they are aware of the responsibilities applicable to them.
Yes. An FSVP Agent must provide a written statement of consent agreeing to act as FSVP Importer at time of entry for a particular supplier and product. Without consent, you would be in violation of U.S. FDA and U.S. Customs requirements.
